Simard admits to voluntarily manslaughter

The case initially went to court after an indictment in front of the grand jury. Wednesday’s resolution proposal was an agreement for a plea to manslaughter. Orleans County State Attorney said the court would decide how much time Simard would serve.

Judge Gregory Rainville told Simard she is charged with using a knife to stab Smith.

“There is no self-defense that hasn’t been asserted in this case that I’m aware of,” he said to which Simard agreed.

Reading from her admission, Rainville said that Simard, on March 28, 2016, recklessly caused the unlawful death of Smith. Her statement, according to Rainville, that she disregarded a substantial and unjustifiable risk that her contact would cause Smith when she brandished the knife during a confrontation. Rainville said that Simard wrote she did not fear nor she or anyone else was a risk of serious injury before, during, or after the confrontation. Simard’s attorney David Sleigh said that Simard has been in custody for three years and would like to go sentencing as soon as they can.
