Doyle told Cleveland she is accused of violating conditions by using controlled substances, specifically that in April 2021, she allegedly used cocaine on two occasions according to drug test results. Doyle also said that Cleveland allegedly violated how and when she should report to federal court. He stated that in May, 2021 Cleveland is accused of failing to return contact requests from probation officers. The third allegation relates to Cleveland participating in substance abuse treatment. He explained that since approximately March 25, 2021, Cleveland allegedly failed to participate in outpatient substance abuse treatment. The judge also alleged that Cleveland failed to submit a urine sample on April 21, 2021, and May 13, 2021.

Marcus Demers

During an arraignment Tuesday, the court also held 36-year-old Marcus Demers. Doyle told Demers the grand jury returned an indictment charging him with five criminal offenses. Doyle told Demers the indictment alleges he distributed cocaine base five times between February 2020 and April 2021. Demers pleaded not guilty to the charges. During questioning from the judge, Demers said he had been treated or hospitalized for narcotics, with the most recent in 2019. Fuller told the court the allegations in the indictment are largely controlled buys that involve using a confidential informant, and some information needs reviewing.

Demers’ attorney Richard Bothfield who didn’t object to his client being detained, said it’s clear he has some addiction and substance use he’s dealing with and dealt with in the past. Bothfield said he’s started the process to get Demers to have an intake with Valley Vista. Bothfield said Demers has been in Valley Vista before, knows the program, and had several months of sobriety. Bothfield asked the court that Demers be allowed to attend Valley Vista without filing a motion.

“I think it’s going to be a quick turn around and hopefully he will get a bed fairly soon,” he said. “We don’t want to risk where he would lose the bed because he had some issue getting back into court quick enough.”

Fuller said the prosecution is concerned with Demers’ (alleged) drug use. Demers was obviously in serious a medical condition the last time they saw him, Fuller said. It was so bad the court could not have the appearance due to significant withdrawal systems, she claimed. While they have not seen the treatment plan, it is something the government would be amenable to when the defense files the plan. In response, Doyle said the court would take it up right away.
